I have reviewed your exchange of electronic messages and discussed the original purchase and return agreement with Ms. Callahan. As of today, you have not made any refund despite your prior agreement to do so. In order to avoid appropriate legal actions to remedy this situation, I am formally demanding that you immediately refund the purchase price within twenty-four (24) hoursof your receipt of this letter in the form of a PayPal payment in the amount of $160.00. After reviewing your Poshmark.com posts it is clear that you sold counterfeit goods in interstate commerce, misrepresented the condition of the purse, and misrepresented that the purse was made out of leather (not vinyl as it was). Sale of gray market goods with the associated trademark violations are taken very seriously by federal authorities and consumer fraud divisions of the state attorneys general. Here, it is clear that you fraudulently sold a counterfeit item and misrepresented the condition of the Gucci bag to Ms. Callahan. As for your agreement to accept the return, we can easily establish that the Gucci purse was returned to you, as we have proof of shipment by Ms. Callahan and proof of receipt that you accepted the return delivery of the “Gucci” purse. Your statement that you do not know whether you have it is not credible. It is obviously wrong on many levels and actionable that you accepted the return and then refused the refund.
