I have seen many 'repurposed', 'upcycled' items( keychains, hats, etc.) on here, and started considering how to do it myself with damaged or old Louis Vuitton bags but wanted to know the legal restrictions. I came to understand that many of these ' upcycled' goods are actually infringing on brands' copyrights/trademarks. I thought I would share, since I'm sure many sellers are unaware they are engaging in this behavior.

allissat@jonchrisprice I was debating making keychains or jewelry, since I see really cute stuff like that on here all the time, but I remembered reading something in passing about an etsy getting closed for repurposed items and so I wanted to know the rules! I definitely think people just don't realize it like we didn't!

lindsey_weemsSome people use fake goods to re-purpose so you really are not even purchasing a true up cycled good. Unless it comes with authentication documentation- I would stay away.

allissat@visualcloset painting on a bag isn't illegal, unless you're painting another artist's copyrighted work. The illegal products I've seen are those ' repurposed' keychains, hats, etc. being sold under the 'Louis Vuitton' brand.

aliciawoodsonPut this like “keep it Gypsy” does and you should be legal. Since some of the LV print has the actual trademark on it that is why it is legally an infringement but disclose it isn’t an LV item and you won’t have any issues.

allissat@sand_98 yes. if they are reselling an item made by boho bags or any other company, the brand name in the listing should be whatever company made the new product. if the seller is the maker, then it should be sold without a brand on the listing.

moonthreadsthankyou for making this! sooo many people do not understand that its illegal.its against poshmarks rules to sell or buy these, YET poshmark is "authenticating" these bags! so if poshmark knows its illegal but they are allowing the sales they are knowingly breaking the law. if you have any respect for these brands you wouldnt be selling these. it isnt illegal to upcycle your own bag for personal use( or thats my understanding)

moonthreads@aliciawoodson actually no, they are breaking the law and lv has sent hundreds of "cease and desist" letters to hundreds of "brands" who do this.you have to have permission from the brand to sell these items.

allissat@moonthreads you can upcycle and customize the bags, the issue is when you're changing the essential product- using materials from authentic bags to make keychains, necklaces, hats.

allissat@moonthreads yeah, the attorney quoted in that article is saying exactly what I am.. .Upcycling is protected under 'fair use'- stuff like adding fringe, custom paint, etc. However- if you add protected property to a different product that is illegal. Customized products( bags/shoes) = totally legal- Using protected( trademarked) products( bags) in a different form/ product(keychains/hats)= illegal.

allissat@petiteshopper So, I am not a lawyer...so dont try to quote me in court lol...BUT.. essentially if you take a bag and paint it, or add studs( whatever) your work is considered art( which has its own protections); and you're not altering the essential product so it's ok.

allissat@petiteshopper However, it is illegal if you take a bag, cut it up and turn it into keychains( or book covers or whatever). Essentially..the protected product is the BAG( not just the company emblem)... and using pieces of it as part of another product voids the authenticity. Then you are using trademarked property( company logos) without permission.

allissat@petiteshopper The same way you couldn't paint 'LV' emblems on cheap sneakers and try to sell them since they would be using trademarks without permission, you can't use pieces of authentic products. Bottom line, the laws are weird sometimes.

Honestly, a lot of those sellers are pretty recent and weren't on big brands' radar but the past year they have( at least LV has) really started going after them. They start with cease and desist orders, and most people stop. I know of 2 sellers on Posh that recieved letters, so it's definitely getting more common.

allissat@ashleysmith1117 how is the bag 'repurposed'? I see a lot of people using 'repurposed' when its just upcycled and vice versa. You probably have to list it under the boutique name instead of Louis Vuitton, and hope they repurposed it legally.

lovetoshop2003@allissat it’s from a boutique called Rockwell Tharp. They said they are one of a kind bags. And for the price I paid it should be 😂. It’s leather taken from LV bags (in this case it was the monogram pattern) and make something different. One side is LV leather and the other is real cowhide.

allissat@ashleysmith1117 so I looked them up and they are definitely selling illegal items. I'm not sure how much you spent/ if its worth trying to get a refund because of the legality of the product. I know you can always get a refund if a product is sold as an authentic item when its not.

erikaleebee@jonchrisprice posh no longer removes items that are pn their restricted or prohibited list. i reported things every day and yet they remain. from used makeup,nail polish, perfume to replicas. there are items i have reported that 6 months snd keep doing every other day and they are still for sale in poshers closets. they do nothing.
