Purchased in mid 2023 and used about 15-20% of jar. I always take the product out to use with a little spatula so the moisturizer is sanitary! Price is firm :)

loelizabethco Please note that I will be pursuing a small claims court case against our sale in the state of California. All legal notices will be sent to the address initially used for the purchase. If you wish to receive legal notices at a different address please advise within the next 48 hours.

leighb23 @loelizabethco I have been a seller on Poshmark for seven plus years and have had to both request returns from Poshmark support and have had my items returned to me as well which can be frustrating. I have never dealt with someone threatening legal action for $50 over a mistake they made. When you sell on Poshmark, you don’t get to make your own rules or fabricate that the buyer tampered with the item to support your case.

leighb23 @loelizabethco It’s clear Poshmark support deemed your listing and comments inaccurately represented the product, and therefore eligible for return. I mailed it back to you this morning in the same condition I received it. Do not message me again.

loelizabethco @leighb23 Your own photos prove my point, you are clearly touching it with your bare hands. I’ve been a seller for over a decade, with a 4.9 rating and 1,000+ sales and have never had a return on a skincare/makeup item, nor had someone attempt to return a product they touched. The amount of this transaction meets the requirements for a small claim, in addition to legal and court costs fees I will be filing as well in California.

loelizabethco . Again, please consider this written notice that I have provided 48 hours to provide a change of address if you wish. Otherwise, it will be sent to the one already provided and all further communication can go through my attorney

leighb23 @loelizabethco Can you please explain how else I am supposed to get the bottle out of the mailing slip without touching it?
Jan 22Reply
loelizabethco
loelizabethco @leighb23 It was sent in a clear, protective packaging to be examined before opening with bare heads. As a seller of cosmetics and skincare, I would assume you know about contamination and hygienic handling of products. Again, from here on out all communication can go through my attorney unless you are providing a change of address for notification or a resolution.

leighb23 @loelizabethco since I have a full time job and don’t have time for this bullshit, I am going to drive back to the post office and see if I can pick up the package. I will message Poshmark and tell them to reverse the decision. Happy? And btw: you did not send this in clear sealant so you should be more careful next time

loelizabethco @leighb23 I appreciate your offer to resolve this in a quick and efficient manner for both of us and would appreciate not drawing it out. The clear packaging was shown in tact in your photo, on top of also being wrapped in tissue paper to provide a second layer. Feel free to let me know if this is resolved within the next 48 hours.

leighb23 @loelizabethco I’ve submitted a note to Poshmark support. In the future, it may be advantageous to heat seal the product if it’s that important to you that the buyer doesn’t touch the bottle. It’s impossible to check the bottom of the bottle to confirm size in the bubble mailer. I am not doing this because I am in the wrong at all (as Poshmark agrees) but because I have no interest in being threatened, so you win. Please be patient as this resolves. Hopefully they get back to me in a day or so.

loelizabethco @leighb23 Please advise if you have any update on this matter as I would like to discuss next steps with my attorney to file if need be.

leighb23 @loelizabethco I just heard back from Poshmark and you should be receiving the money soon. While you “appreciated” my willingness to resolve this, I cannot express how irritating this has been and how much I don’t appreciate how you’ve handled this. I think it’s pitiful that instead of owning up to your mistake, you decided to bluff/ threaten me. You’re lucky I value my time too much to deal with you anymore
