amrowe28 How do you copyright your pictures? I hope that isn't a stupid question but I've had girls use my photos and then people accuse me of not having the items!! So frustrating!!

mloest @amrowe28 well, one way is to contact Poshmark. Another is to make a listing like I did notifying "the public" (Poshmark users) that my photos are private, meaning no one can just use them legally. I had an issue several times where people would resell items bc they didn't check to make sure what they were buying fit right, so they'd resell it without asking me to use my photos. I cannot guarantee or attest to what some other person is selling. It could be a duplicate item, a knock off, damaged, etc and who's to say that what MY photos are displaying is accurately being represented? So I contacted Poshmark and they will back you 100% if that ever happens to you. They told me to create a listing basically telling people not to steal your photos without at least asking. It worked so far!

mloest @crystalbliss12 I know right! I always ask before I ever use someone else’s photos, but I think I have only done that one or two times? I know when it happened to me, Poshmark took down the persons’ listing, but I don’t know if that’s still a rule or not. I think it is, so that might help you out if you want to contact them, I would bc that’s so rude!!

I’m not trying to be a butt about it but I also don’t want to be held responsible if someone resells my item that didn’t fit, or maybe they have the same thing I do and then the person thinks it fits like how I’m wearing it, looks the same, or overall is the same item and it may be damaged or stained, etc.

mloest @rgstyleshop I had someone come to me when they bought something off of someone else using my photos and that’s how I learned about this, I actually spoke to support and the info I posted is 100% accurate! The buyer tried to blame me for not receiving her item properly bc the other seller used my photos! It was awful! I was so mad!

And I think Poshmark booted her bc of her using my photos for the sale of a misrepresented item! Luckily that’s over and I posted this....and then I learned of other peoples interactions! I really hope this helps people!

mloest @rgstyleshop other than from websites, I’ll use those photos but if I specifically find an item on here that isn’t sold (sometimes if it’s a generic item from a sold listing, I’ll use the old manufacturers photos, as long as I know it’s not private photos).

I don’t usually post it on the messages section bc I might come across as a spammer, but I almost always get permission unless it’s for a manufacturers photo that I couldn’t find myself otherwise!

I had to report the seller who didn’t ask for permission on mine too, and they made her take it down immediately. If someone asks, I’ll usually let them do it, but if they don’t, I get super mad!

ffl314 I recently noticed another seller used my photos of my bag that I’m selling in her own listing. I reported to poshmark on Thursday and have not heard back. I emailed poshmark again this morning because her listing is still up with my photos. I’m surprised poshmark is not responding and I’m wondering if you have any recommendations of what I can do. I did not think poshmark allowed people to do that and I think it’s deceiving to her potential buyers.

mloest @ffl314 hello and thanks for reaching out! I’ve had this happen to me quite a few times. Have you reached out to the seller? You can make it private if you’d like by creating a bundle using the listing of the item and you could explain to her the concerns. The problem I have with it is that most items aren’t the exact same, even if they’re the same thing.

mloest @ffl314 Condition and look will always vary, so you’re right, it’s misleading and the buyer will come after you as well, if they’re unsatisfied. It puts unnecessary liability on you. That’s why I always ask to use someone’s photos, which is very rare anyway. Poshmark does not support the use of other people’s photos for many reasons.

mloest @ffl314 Usually they take forever to reply to a concern, which is why I suggested contacting her first to try and talk it out (if you think it’s possible to do so). They should respond within a few business days. You’re not alone, it really sucks and I hope it gets resolved in your favor soon!

ffl314 @mloest hi thank you for explaining all of this. I did ask her to please use her own photos under her listing since I didn’t give her permission to use mine. But she did not respond to me :/ Poshmark finally got back to my report (took 5 days) and it looks like they deleted her listing. I found it frustrating because it took them so long to even respond that they were looking into it. But I’m glad they finally did take careful of it. Thank you again for your help/explanation 😊

She has a big account & been on 2 years, so I hoped she knew the rules. She wrote back fast apologizing saying she thought it was from a store site & has removed it. I told her I take the time to make all my own photos collages & appreciate it. Now I think I will have to also put my closet name or watermark on each.

mloest @narias_closet yes absolutely! Take screenshots of the replicas with the persons’ screen name, then contact Poshmark support. If you feel comfortable, I would try to resolve it by letting them know there’s a potential their closet will be limited, suspended, or shut down completely if they don’t remove it. Those are Poshmark’s rules and they adhere to those specific rules very strictly. Please lmk if I can help in any way!

angiebryan This just happened to me, the user is using my photos and someone else’s and not one of her own and now she keeps price cutting me! I’m so annoyed. I kindly told her to post some of her own photos and she was so nasty with me saying I was just jealous her price was lower and that I found the pictures online and didn’t take them myself, when I did in fact take them. Then I was instantly blocked and made to look dumb.

If anyone wants to help me report this abuser, please use the report button on her Tiffany Mesh bracelet listing! The lady bought them for 10 , gave me a 4 Star rating and when I looked on her page. There they were for 40 with all of my pictures and only my pictures! She said that there’s nothing in the rules that state that she can’t do that

angiebryan @krede715 I actually emailed poshmark support saying that I own the pictures and do not give permission for @user to use them. You have to attach the original photos from your phone (not screenshots), and they will remove the listing all together! I also included a screenshot of their rules that state you can’t use photos without permission. You can find that on their website 😊

nicas_closet Thank you for posting this! I just had the worst experience and I’m so mad right now....reading others stories made me feel like I’m not alone in this. I had a buyer who marked my item as delivered, but did not rate me. I Immediately saw she had listed the item on her page but used my photos and description. I reported her to PM for copyright infringement and they resolved it right away by removing the listing......

nicas_closet She then immediately relisted the item but cropped my photos even smaller, but you could still see it was my photos, so I reported her again. They once again removed them immediately. So now, she decides to rate me 1 star claiming it was for cleanliness because the item smelt bad!! I have never in my 12+ years of selling across multiple platforms, have I ever mailed out something that was dirty or smelled bad. The item I sold her was new, with tags. I am so livid right now......

mloest @312posher first I communicated with the other person politely and asked her to take them down and gave her a deadline to do so. When that didn’t happen, I emailed Poshmark support with screenshots and the users’ name for reference of the listing. I sent the ENTIRE listing and then I sent my entire listing just of my photos as proof.

mloest @312posher after they investigated it, it took a few days, not only did they suspend her, but they froze her account, wouldn’t allow her to do anything but sell. No bargaining/offer option. Nothing. No messaging. Just if a random person bought at full price from her closet. She did it again, so I reported her and in like a day, her account was disbanded and removed by Poshmark. And I got an email stating they closed her account.

mloest @vivaglamlove if you read my most recent responses to others with the same issues, that may help. I was able to have the poshers (yes as in multiple) banned permanently. 👍🏼 I was happy! Now, I’ll use someone’s photos but I will NOT publicly ask permission. I usually set up an empty bundle and screenshot our private conversation, only because I don’t want it to appear like I’m spamming their closet. So about 3% of my photos are “borrowed” but some people take better photos.

thisthatshack I googled this because this happened today. Mine were stolen by a Poshmark ambassador. She had previously lowballed me, when she got the item she gave me a low rating and said my brand new NWT item had a spot on it. I know it was flawless when I sent it out. Then I see it reposted in her closet for double what she paid using my photos.... She was about to make another purchase when I noticed. I had Poshmark remove the photos. I blocked her, Its not my job to build her store for her.

However, I just noted, the seller just removed the listing (I had to ask the seller 8 times to remove my images and mentioned that I would report them to Poshmark). I did ask them to use their own images in the future. Any advice would be appreciated in case this happens again. :)~

I did ask kindly, I will alert you at this time that I did email them regarding this. There are a NUMBER of reasons as to why posting someone’s ACTUAL ITEM can be problematic. Here is a thread to enlighten you. Again, you have MY jacket amongst the stock photos - that is misrepresentation and infringement

If you’re not reposhing something (which then, Poshmark takes on that liability), and you’re solely using someone’s photos without approval, then you are looking at getting shut down. I’m trying to remain impartial but she’s not threatening. I’ve had this problem-hence my post-and I’ve had people shut down multiple times. Take the advice.

When I commented telling @dshanno she did not have the right to use my pictures especially when I have that item up for sale SHE BLOCKED ME!! I had to sweat in the hot Florida sun taking pictures of my jewelry for 2 hours just to have someone swoop in, claim them as their own, and sell the necklace with my images. Very unethical

Honestly if she had rated my item..which was pristine by the way...I would probably report her..as it stands..I'm a newbie and don't want to get hit with a 1 star retaliation rating nor do I want to give her thieving A*#@#S any energy or time..I have enough stress without adding a Posh battle to the mix..and I believe in karma.

And it’s misrepresenting YOUR listing and YOUR item because the buyer of that potential seller is expecting their purchase to arrive looking like yours, and our tags/names are at the bottom of our photos. Ugh! I have had several people banned bc of this rule so I hope you know let this person know bc Poshmark will uphold that rule 100%!

You can just look up my username on the internet. Those listings I didn’t post on my Poshmark. I don’t know what to do now.

When people steal my pics, I send them a message in legal form explaining that the photos I use are stock provided to me by the vendor who gives me permission to use them and when I make a listing with them, they become my intellectual property and they’re in violation of Poshmark’s TOS. kgsouthbeach @amrowe28 @mloest Also, you can go to your settings and toggle off the option to allow or prevent buyers from using your photos for reposhing purposes. I’m constantly having to confront other people for taking my photos. They will argue with me and tell me they found them on Google. Regardless, it’s still my intellectual property, and I will do whatever it takes to prevent anyone from taking it especially when they have done no work nor paid for the program.

mloest @kgsouthbeach omg you’re amazing! I completely agree and I love that you’re doing that. That further protects the copywriting of your photos and the protection of your “property” (in this circumstance: photos). I think it’s awesome you do that and thank you for that advice!

mloest @kgsouthbeach If someone politely and merely asked, I would consider it, and any time I ever use others’ photos, it’s 100% with their documented approval beforehand. I absolutely despise how Poshmark allows people to “Reposh” and that person can literally use the original photos. It’s so not okay!

kgsouthbeach @mloest If you go to the main menu and tap on MY SELLER TOOLS you’ll find an option to tap REPOSH SETTINGS. Tap that and toggle off the button that allows buyers to use your photos. My issue is I sell retail on here and it’s HIGHLY competitive and setting yourself apart from the competition is essential. I am self-taught in graphic arts and it has taken YEARS to get to the level I am now. Continued….

kgsouthbeach @mloest So the fact that it took me about two years to master the app, the amount of money I spend on the app plus the amount of time it takes to create the listings is not something I am willing to just give away free. I would not even let people BUY my listings as they are what set me apart in this competitive market. If they want to pay me to create something special for them, I’d do it. But it wouldn’t be cheap. kgsouthbeach @mloest Most of the time people don’t argue and simply weren’t aware of the law behind it. Or, they know what they’re doing is wrong but don’t argue because of the legalese I use which, for all intents and purposes, scares them into taking it down. kgsouthbeach @mloest It will take me a minute because I’m in the middle of something. But if you do a search for Easel mineral washed pants, you’ll see why my listings set me apart. Plus I am price competitive and offer excellent customer service. (I’ve refunded a customer over $230 when I was only paid $169 for a sale. Other sellers said I was crazy, but now that customer is one of my best customers and is extremely loyal.) I’ve got a ton of tricks up my sleeve!

kgsouthbeach I’m a former lawyer and have a 3 part message that I copy and paste to send to people who steal my photos. Most of the time it works and I get an apology because people often don’t realize what they’ve done. Sometimes I do have to take the issue to Poshmark to force the removal or the seller will take offense, but that’s not my problem. As long as @mloest doesn’t care, I’ll post the messages here for everyone to use.

In using my listing photos, not only are you in violation of Poshmark’s TOS, but also the United States copyright law contained in chapters 1 through 8 and 10 through 12 of Title 17 of the United States Code.

kgsouthbeach I will give you 48 hours from this day [insert date and time, don’t forget to mention your time zone] to remove my listing photos and replace it/them with something else. I do not like to be mean, but it has taken me a long time to learn how to use the app to make my listing photos and costs a monthly fee. Additionally, I spend a lot of time to make sure that my listing photos are uniquely different in order to stand apart from my competitors in this competitive field.

I will take any and all necessary measures to protect my intellectual property, starting with notifying Poshmark of the violation of their TOS to taking whatever legal action in which I am entitled. I recently had someone steal 7 of my pictures / listings that they’ve posted in their closet without my permission and I’ve contacted poshmark several times and nothing has been done about it. The listings are still up. They told me to use the report button but there’s not an option for reporting stolen pics. Her name is @kellilillian18 she has 7 dresses that are mine and live in my closet. Any ideas how to get her listings removed? She has blocked me

runninginadress I had over 30 separate product photos I took all stolen and used as their own and the process of having poshmark remove them is so tedious. The worst part is they cross listed to multiple platform all with my personal product photos
