New w/o tags. excellent quality. Kuhl is my favorite casual athletic brand. I have 3 pairs of their pants. But the Small is just too tight for me. It does run a touch big, so I would say between a small and medium. Color is Evergreen. It is a beautiful color, much richer than the photos.
