Black flapper style cocktail dress - Kate Spade

Reposhing this item I purchased from @zachy10. Loved it, but doesn’t fit right (little too big up top). Also, please see last picture, looks like some of the fringe was cut off which was not disclosed when I purchased the dress & I just noticed it - cannot tell unless you look close :(
