alexandt Love the inclusion of the First Sale Doctrine, but for public awareness as well: It’s important to note that the First Sale Doctrine does not extend to situations where the quality of the good is materially altered enough to be considered misleading.

alexandt Furthermore, individuals cannot claim protection under the First Sale Doctrine if a material difference in the product being sold will create consumer confusion as to the source or brand of the product. e.g. changing the packaging of a good can be a source of confusion etc. So for verification, the packaging being provided is also the authentic packaging that came with this wallet, correct?

carlieposh91 @alexandt Hello. All of my items are purchased 2nd hand! this was the packaging that came with it from the site I purchased it from. The 1st sale doctrine is for resale purposes for me, simply as a verified reseller stating I do not claim anything within their individual copyrights and its my business to re-sell any and all authentic items purchased by me

carlieposh91 @alexandt So the box/distbag etc were all provided with my purchase when purchased from the real real, and whomever purchased it and consigned it to them provided the box/dusbag/carr cards etc and I purchased it there! So all items I purchase to work on/clean up/etc are 2nd hand preloved and protected to re-sell as used authentic pre-owned goods

carlieposh91 @alexandt So essentially with the 1st sale doctrine its essentially protection for resellers or sellers of any purchased good that has protected copyright logos, etc on them, and since the protected logo good was purchased lawfully and is authentic/has been authenticated its my right to re-sell at any point after my purchase. It wouldn't cover people that buy it and then try to resell it as like "Janes Wallet" with a YSL logo on it haha

carlieposh91 @alexandt But also, I don't know why you find this walley to be 'misleading' ? it's not altered in any way, it was cleaned, conditioned, hardware shined, and its unaltered in any way. And comes with the packaging provided to me when I purchased it; I suppose if someone didn't want that they don't need it, but all items include different inclusions/some none at all, etc; and are listed in the written descriptions

carlieposh91 @alexandt But yes its a regular YSL box, ysl dustbag and a set of ysl care cards that were provided with purchase from the realreal, and whomever consigned it to them for selling, included the packaging materials when it was sent to teh real real for selling. And therefore were sent to me and included with my purchase when I bought and received it in addition to therealreals tag. I don't typically see altered boxes or dustbags? or recieve them from orders?

carlieposh91 @alexandt So yes the box, dustbag ans care cards are all YSL ones, from the original owner that included them and I purchased it, that's all I know, they're included unless someone didn't like them or want them, but I always include what I recieve with my items, i.e. boxes/dustbags/ etc, that I work/clean up and sell. It shouldn't cause any confusion however including the box/dusty/care cards with the wallet, or at least I would hope it wouldn't

carlieposh91 @alexandt You can read my love notes if you have concerns, I'm also a verified reseller partnered through Poshmarks authentication program. I price my items fairly ans don't proce gouge. This wallet has marks/light scratching to the front/back and retailed originally at around $495...so I don't typically sell my items for more than they're worth, particularly not one that shows wear/or when items are not brand new

carlieposh91 @alexandt I have no problem selling it for more prosperity for $500+...however I price items accordingly to signs of use/amount of time and work put into an item, etc! So I don't typically try to charge more than an item retailed originally for, especially with wear present! But if someone wanted me to make it more, then I could post it for more, but I try to list my items accordingly to original retail price/wear/the fact that all are pre-owned, etc!

The 1sy post on my page has some information on verified resellers, but essentially all of my items go through authentication when I purchase, then as my responsibility as a verified reseller i put then through/pay for a 2nd authentication and pay for a certificate before the item gets posted! And then since my items go straight to my buyers, once a buyer receives an item they can

carlieposh91 @alexandt also request a 3rd authentication/virtual authentication that Posh offers to buyers of Verified Resellers partnered in their authentication program! So yes I can raise the price but it would be over retail, and is 2nd hand/has marks/call outs listed etc!
